Introduction

From 2025 onwards, the Digital Markets, Competition and Consumers Act 2024 (‘the Act’) introduced new obligations for businesses who display reviews to implement and publish a consumer review policy which sets out how they prevent and remove banned reviews.

The Competition and Markets Authority (‘CMA’) has advised businesses that they must take steps to address the new automatically unfair practice of submitting or commissioning another person to write a fake review or a concealed incentivised review.

With enforcement activity anticipated, businesses will be expected to have a clear consumer review policy in place which sets out how they prevent and remove banned or fake reviews.

The CMA has provided practical guidance on how business may comply with this requirement. Failure to comply can result in a maximum penalty up to £300,000 or, if higher, up to 10% of the total value of a business’s turnover.
