Introduction

Utility companies (electricity, gas, telecoms, water and drainage) hold wide statutory powers to take rights over land, alongside outright compulsory purchase powers. In practice, clients meet the utilities sector in many ways: new rights of access may be demanded; existing apparatus can complicate development, redevelopment and future land use.

This virtual classroom seminar will equip lawyers, surveyors, planners, and developers with the legal sources, processes, and valuation principles that govern utilities’ rights so you can respond confidently, protect projects, and negotiate fair compensation.

What You Will Learn

This live and interactive course will cover the following:

  • Sources of power across electricity, gas, telecoms, water and drainage: who can exercise which powers, pre-conditions, limits and interfaces with planning/land law
  • Procedure and engagement: notices, time limits, evidence, and dealing with site access requests; practical tactics for negotiation
  • Valuation and compensation: initial taking of rights: principles, valuation bases, evidence of value impact, and documenting settlements
  • Compensation: subsequent exercises of entry rights: when further payments arise; disturbance heads of claim; records and proof
  • Removal/resisting installations: statutory tests, alternatives and accommodation works; balancing development needs with utility functions
  • Disputes and resolution: routes, forums and timeframes; preparing a defensible file; costs and settlement strategy

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
