Domain Name Disputes - Practical Considerations & Recent Case Law
Introduction
With over 1,500 generic top-level domains (‘gTLDs’), domain name registrations remain an important part of business in terms of your own domain name that you use and operate, and the domain names that third parties adopt.
Whilst the huge number of gTLDs means that there will be many identical second level domains that do not cause an issue, there are still several domain name problems that a business may encounter.
The World Intellectual Property Organisation (‘WIPO’) deals with some domain name disputes and receives approximately 500 disputes per month.
Legal practitioners and businesses should therefore be aware of potential issues with domain names and the action that can be taken if a third-party domain name causes, or is likely to cause, issues.
This short webinar will examine the Uniform Domain Name Dispute Resolution Policy (‘UDRP’) that applies to a number of domain names such as .com and the Nominet DRS procedure, which is relevant in the United Kingdom (for example for .uk and .co.uk) and will look at the key points to consider when contemplating filing a domain name dispute, as well as recent case law.
