Introduction

Pricing transparency is increasingly a high priority for the Competition and Markets Authority (‘CMA’), with further enforcement set to continue in 2024.

The risks in this area will only increase as the CMA is granted new powers to impose penalties of up to 10% of global turnover under the Digital Markets, Competition and Consumers (‘DMCC’) Bill, which is due to comes into force in mid-late 2024.

Consumer law is having to evolve quickly to respond to emerging issues such as dynamic and personalised pricing (including via the integration of AI) - while tackling misleading price promotions and bogus discounts remain high on the CMA’s agenda.
