Introduction

The regulation of the allocation of social housing is complex.

Understanding the legal framework requires knowledge of housing law, equality legislation, human rights and public law.

This virtual classroom seminar will give an overview of the relevant law and provide practical, up-to-date guidance on key areas of challenge to local housing authority allocation policies.

What You Will Learn

This live and interactive session will cover the following:

  • Legislative framework to housing allocations:
    • Part VI of the Housing Act 1996 and the amendments introduced by the Localism Act 2011
  • Analysis of key areas of challenge, including:
    • Whether the allocation policy is framed so as to secure reasonable preference to the statutory classes in s166A(3)
    • Interpretation and application of policies
    • Discrimination under the Equality Act 2010
    • Application of the public sector equality duty
    • Use of Human Rights legislation
    • Significance of the Children Act 2004, s11
  • Important and recent High Court decisions
