Introduction

5.7 million family members provide care in England and Wales, often to their financial detriment with 20% typically providing in excess of 50 hours care a week. The carer may have to stop work, reduce their hours or find a lower paid job that fits around their caring role. In England alone, it is estimated to save the State £1.6 billion. The cost of professional care can be up to £130,000 each year, but with no guarantee of it being of a good quality. It is no wonder that family members step in to help out. However, there are risks. Is the family member an employee, or is any money paid a voluntary payment and does it need court authority? What if the carer does not get paid and seeks restitution of funds by arguing that the cared for person's estate has been enriched by their care?

This virtual classroom seminar will look at the availability of using the person’s own resources to pay a carer to care and the legal framework, together with local authority or NHS direct payments being used to pay for a family carer and includes developing case law.
