Introduction

Often referred to as accessory liability, claims for knowing receipt or dishonest assistance involve taking action against a party who has been involved in another’s breach of fiduciary duty, either by having received property pursuant to such a breach, or by having assisted in the breach.

Such claims are pursued commonly further to a fraud or other wrongful conduct, whether in addition to or alongside action against the fiduciary.
