Introduction
Copyright protection is an increasingly important consideration for creators, and businesses, operating in all sectors, and in all jurisdictions, particularly as technology develops rapidly - notably in the arena of artificial intelligence - and new challenges associated with developing, distributing and protecting content emerge.
This new virtual classroom seminar, which will assume a working knowledge of copyright law and practice, will address several key areas in depth.
What You Will Learn
This live and interactive course will cover the following:
- Exhaustion of IP rights - the current position
- The rise of artificial intelligence - can AI-created works be protected by copyright?
- Assignments and licences of copyright:
- When is an assignment actually a licence, and vice versa?
- Conflicts of laws, particularly in respect of different regimes’ reverter provisions
- The enforceability of agreements to agree
- Assignors’ rights to royalties
- Publisher-assignees - what (fiduciary) duties are in play?
- Moral rights - what are they, how do they operate in practice, and what remedies are available?
- Copyright authors and employment - the application of section 11 of the Copyright, Designs and Patents Act 1988
- Incidental inclusion and its limits
- The boundaries of artistic works and how they are evolving
- Infringing works - is there any copyright protection?
- Case study - copyright in buildings and architects’ plans and drawings - rights of panorama and remedies for infringement
- Case study - ghost writers - what protections do they enjoy?
- The surviving legacy of earlier Copyright Acts (including automatic assignment reverter)
