Introduction

In the last few years, there have been a number of fashion brands getting involved into cultural heritage case law due to unauthorised use of art no longer protected by copyright (e.g. Jean Paul Gaultier and their use of Botticelli’s Venere), especially before Italian Courts.

Italy is the only country with specific legislation protecting cultural heritage independently from intellectual property rights.

As a result, often brands are not aware of the limitations in place and requirements to comply with to use artistic works as part of their global projects.

This short webinar will examine how similar issues are faced in other jurisdictions, including the UK and US and what practical implications regulations have for brands, including step by step guidance on how to deal with cultural heritage on a global basis.
