Community Care & The Children Act - Latest Update

Introduction

This is a practical course, identifying key themes in relation to community care legislation as it affects children across different statutory schemes and in relation to various public bodies with powers and duties in relation to children. The course will consider recent developments in case law and guidance and offer case studies to support understanding.

• Overview of statutory schemes and guidance including Children Act 1989, Housing Act 1996 and Care Act 2014 as they affect children
• Which public authority is responsible for meeting a child’s needs - children’s services, health, housing?
• Families without recourse to public funds - powers and duties of local and central government - including LR v Coventry City Council [2025] EWHC 20 (Admin)
• Child in Need assessments: when does a s.20 Children Act 1989 duty arise, and when are leaving care duties triggered? Consideration of R(King) v Essex CC [2024] EWHC 264 (Admin)
• Transitions between children’s services and adult social care
• Child deprivation of liberty - can a local authority with a care order consent to a deprivation of liberty? Analysis of J v Bath and North East Somerset Council & Ors [2025] EWCA Civ 478
• Future issues: changes to the Children and Families Act 2014 in relation to EHCPs?
