Introduction

You may be asked by a client or a colleague to advise upon or create an agreement or arrangement regarding data licensing or data sharing to ensure that:

  • Rights in the data (including IP) are protected
  • Use of the data follows data protection laws

This new virtual classroom seminar will cover the key issues when considering any type of data sharing and related IP issues.

The session will help you to be better informed about how to protect IP rights whilst, at the same time, comply with data protection laws. It will also include analysis and reviews of recent case law and developments in this area.

  • Who owns the data and rights in and relating to the data?
  • What can the data be used for and not used for?
  • Who else can use the data?
  • Can the data be modified or transferred to other parties?
  • Should there be any confidentiality and data security obligations and how will these provisions interact with IP rights in the data?
  • The types of assurances that are given from an IP and data protection perspective regarding the data (e.g., the data being accurate and free of viruses)
  • How and in what form will the data be shared?
  • How will updates of the data be created and which party will own those updates?
  • What can do if your data is used for unauthorised purposes or in breach of any data and IP licences?
