Introduction

2025 has been a busy year for the Courts, and therefore for case management. The key parts of the CPR, Part 31 and its Practice Direction set out the rules for one of the most important aspects to Litigation: Disclosure. This distinct phase of proceedings requires the Parties (whether two, or several) to tackle the matter of evidence. The Court pays close attention to Disclosure as a matter of balancing access to justice and efficient and proportionate case management.

Disclosure is an important milestone.

This webinar focuses on the legal requirements for Disclosure, the step-by-step process and the practical steps. It will explore review opportunities.

Key 2025 cases will be highlighted with practical tips: the latest in the Duke of Sussex v MGN litigation (re proportionality, weight, costs); Kul & Mahir v DWF (re requests for specific disclosure and GDPR in RTA) and Dare International v Kayaam (re applicable tests for non-party disclosure). Plus a case from late 2024, RSA v Kroll Advisory (timing for making non-party disclosure applications and orders). It will also briefly cover Dixon v North Bristol NHS Trust, Ayannuga & Ors v One Shot Products Ltd, and Vardy v Rooney.

The webinar is industry and sector agnostic, and designed broadly for anyone involved in litigation, but will be particularly useful to practising lawyers, paralegals, junior barristers, case managers and case assistants who deal with the day-to-day of case management.
