Introduction
The Data (Use and Access) Act 2025 is being brought into force in stages. On 5th February 2026 a number of changes to the Data Protection Act 2018, UK GDPR, and PECR came in to force.
In this short webinar, Robert Bond will highlight the changes.
What You Will Learn
This webinar will cover the following:
- How the general prohibition on significant automated decisions is replaced with a more flexible regime, restricting it mainly to ‘special category’ (sensitive) data
- The list of ‘recognised’ legitimate interests, allowing data processing without a full balancing test
- Rules on setting cookies for scientific research or non-intrusive purposes are relaxed
- The threshold for refusing or charging for a request is updated from ‘manifestly unfounded or excessive’ to ‘vexatious or excessive’
- A new ‘data protection test’ introduced for evaluating appropriate safeguards, simplifying transfers
- ICO enforcement powers are modernised, with fines for PECR (e-privacy) breaches increased to align with UK GDPR levels (£17.5 million or 4% of global turnover)
- Enhanced protections for children are introduced
