Statutory Sick Pay from Day One - What Employers Need to Know
Introduction
Under the Employment Rights Bill, on a phased basis, employers will need to respect the provisions of 2025 employment legislation. One such provision will entitle workers to be paid from the first day of sickness, changing the way that we have operated Statutory Sick Pay (SSP) for decades, scheduled to take effect from April 2026. Further, SSP will be paid to more workers with the removal of the earnings criterion.
Software developers will include this change in their products for days of sickness on and after 6 April 2026. This is fine for the calculation of SSP; however, employers must not forget the interaction with occupational entitlements to ensure compliance.
