Singapore’s Approach to the Evolving UK Litigation Funding Landscape - Webinar
Introduction
The Civil Justice Council (CJC) recently published its Final Report on Litigation Funding in June 2025 recommending a series of reforms to litigation funding in the UK.
Notably, the report includes a recommendation to reverse the UK Supreme Court's recent decision in R (PACCAR) v Competition Appeal Tribunal (which held that litigation funding agreements could constitute damages-based agreement and therefore be unenforceable unless they comply with the relevant regulations) and makes a number of recommendations for the introduction of a regulatory framework for litigation funding, as well as litigation funding in collective proceedings or representative actions.
Understanding the UK’s approach to enforceability, regulation, and collective proceedings will assist lawyers in Singapore to structure funding agreements, navigate risks in global litigation strategy and stay compliant with both local and foreign standards.
