Introduction

This short webinar will consider the recent judgment of Senior Judge Hilder in Irwin Mitchell Trust Corporation v PW & Anor and in particular, the issue of conflict of interest where a deputy is seeking to instruct a connected asset manager.

This judgment considers whether the appointment of an associated financial management practice is an actual or potential conflict of interest and whether that appointment is voidable.

The webinar will be of particular interest to professional deputies with an in-house, or associated, financial management arm (including those with joint venture agreements).

The judgment has potentially far reaching and significant consequences for practitioners and their firms; such practitioners and practices need to be aware of the judgment and ensure they are complying with it and taking appropriate action regarding existing matters where a conflict arises.
