Introduction

When a parent dies leaving a will, what rights do children truly have? Understanding these entitlements and the changing legal landscape surrounding them is crucial for practitioners advising families, executors, or beneficiaries.

This new virtual classroom seminar will cover the succession rights available to children in respect of their parents’ estates where a parent has died testate. It will outline the application process and the principles the Courts have developed when applying the statutory criteria in the Succession Act that govern a child’s entitlement to seek provision under Section 117. The session will also consider the Law Reform Commission’s proposals for significant reform of this entitlement, which, if enacted, would substantially restrict a child’s right to seek such provision.
