Pleading & Proving Your Case - The Law & Tactics with Dominic Regan
Speaker
Introduction
It is essential for every litigator to be aware of the Rules applicable to pleading and then proving the case of their client.
The conventional approach is that a party must set out in clear terms what exactly it is asserting. A trial Judge acts as a referee. It is improper for the court to decide any case on issues not pleaded. That is why pleadings are so important. For example, a defendant who fails to allege contributory negligence will be liable to pay 100% damages to a winning claimant even if there is screaming evidence of fault.
Join Professor Dominic Regan who will guide you through the tactics that make pleadings and proofs effective.
