Introduction

The regulatory frameworks for payment services in the EU and UK are undergoing major reforms, which will affect firms across the sector, including banks and other payment service providers.

The EU is pressing ahead with its revised regulatory framework under the third EU Payment Services Directive (PSD3) and the accompanying Payment Services Regulation (PSR), and the UK is continuing to review and update its regulatory framework.

Both regimes include enhanced anti-fraud protections, new rules on safeguarding of customer funds, open banking and conduct of business requirements. However, EU-UK divergence is emerging in the details of the revised regulatory frameworks, and this has significant implications for firms with cross-border businesses.

The UK and EU are also taking different paths in their regulation of cryptoassets in ways that impact the payments sector. The EU was the first to develop a comprehensive regulatory framework under the EU Markets in Cryptoassets (MiCA) Regulation and is considering changes to that framework. Meanwhile, the UK has developed a similar but distant regulatory framework with differences to MiCA in scope and in regulatory authorisation and ongoing requirements.
