Introduction

This virtual classroom seminar will unpack the most recent cases and help you stay up to date with developments in the case law relating both to traditional partnership and LLPs.

The seminar will enable discussion of key issues in an interactive question and answer format.

    • BCG v HMRC: a high level overview of the key partnership points emerging from this important recent decision in the Upper Tribunal (Jeremy Callman having been lead partnership counsel in this case).
    • Tesco Stores Ltd v Union of Shop, Distributive and Allied Worker and Others, Tribe v Elborne Mitchell LLP, HFFX LLP and Others v HMRC: decision making in partnerships and LLPs, just how far will Braganza duties be applied in partnerships? The recent law in this fast-evolving area.
    • Scott v Walker Morris LLP: when will an LLP’s refusal to extend a compulsory retirement age under an LLP agreement constitute age discrimination under the Equality Act 2010? What approach will the courts take to considering the compatibility of compulsory retirement provisions and decisions in respect of them with the Equality Act?
