Non-Molestation Orders - A Family Lawyer’s Guide to the Present & The Future
Introduction
Non-molestation orders are a key tool to help protect some of the most at-risk and vulnerable people in our society.
They were a regular diet for lower-level courts across the country with little oversight from appeal courts until the case of DS v AC in 2023 and the subsequent guidance.
The implementation of this guidance, and the use of NMOs given today’s developing understanding of different forms of abuse (following the Domestic Abuse Act 2021 and F v M) are important areas about which understanding remains variable.
The recent pilot of DAPOs (domestic abuse protection orders) in certain areas may assist in developing the protections offered to survivors and provide another route through which the law can provide said protection.
