Introduction
Non-financial misconduct has been a real area of focus for the FCA in recent years. It follows the #MeToo movement, which led to a shift in society’s expectations on how misconduct should be treated, in the workplace or otherwise. In light of this focus, and in particular the reputational consequences of not dealing with such issues in line with regulatory expectation, firms (and HR and compliance professionals in particular) have been grappling with potentially thorny issues relating to non-financial misconduct. Following multiple consultation papers, the FCA has now issued finalised rules and guidance, which will take effect from 1 September 2026.
