Introduction

With the cost of living increasing year on year, very few people can afford to buy alone. Even when people do buy alone, they may well have financial assistance from someone else assisting them which could lead to that third party having an interest in their home.

Conveyancers are often asked to advise on joint ownership at the outset but perhaps have not appreciated the issues that can arise if couples split up or there are disputes between parties much later after the transaction has completed that they could have advised a course of action upon.

This webinar will provide an update on the potential issues using practical, real-life-tested solutions.

What You Will Learn

This webinar will cover the following:

  • A recap of the basics of joint ownership
  • Taking instructions to avoid issues and what to advise clients they should be considering
  • Drafting the documents such as the transfer or declaration of trust with some practical examples of what to include in the same
  • Restrictions to protect interests based on standard HM Land Registry restrictions that are available
  • Lenders attitudes towards joint ownership in particular those who provide Equity Release mortgages
  • Case law surrounding undue influence and severance of joint tenancies

This pre-recorded webinar will be available to view from Monday 19th October 2026
