Introduction

This short webinar provides a concise update of recent decisions shaping insolvency law in England and Wales. It explores how the courts have addressed discrete emerging practical and doctrinal questions across both corporate and personal insolvency and attempts to draw out the underlying themes which form the foundations of those decisions.

The cases discussed will address the following issues:

  • When can or ought a statutory demand be challenged on the grounds of jurisdiction?
  • Is an entitlement to redress under the Sub-postmasters compensation scheme ‘property’ which vests in a Trustee-in-Bankruptcy?
  • Can an order vesting the property of a dissolved company in its shareholders be made where that property has passed to the Crown via the doctrine of escheat?

Together, these cases illustrate various themes which should continually be in the minds of insolvency litigators and professionals - the need to balance fairness, the distribution of risk, and commercial reality.
