Introduction

In April 2025 the Supreme Court ruled in the case of For Women Scotland v The Scottish Ministers [2025]. This ruling defined sex, in the Equality Act 2010, as meaning biological sex. The case has caused concern through the transgender community, particularly with regard to single sex spaces and services, which can now be provided for those with the relevant biological sex, regardless of a Gender Recognition Certificate.

However, gender reassignment is a protected characteristic in the Equality Act 2010, and those who have undergone, or are undergoing, gender reassignment are protected from discrimination. How should transmen and transwomen be supported in the workplace, and what does the 2025 ruling mean for them?
