Introduction

Applications for deputyship have increased since the pandemic.

Clients that held off making Lasting Powers of Attorney (‘LPAs’) started to realise that they needed them but found that all too often they had left it too late, and they lacked the capacity to create one.

If you visit a client who lacks capacity to create an LPA, you should offer to provide the Deputyship Service.

This new full day course will walk you through the whole process from taking instructions, the mental capacity assessment, preparing the forms, submitting to the court and what happens once the court orders are made.

It will offer tips and advice on getting the best chance of your application being accepted without further question or delay.

The course is suitable for qualified practitioners who are already providing LPAs for their clients.

What You Will Learn

This course will cover the following:

  • What is a Deputy?
  • When is an application necessary?
  • Who can make the application?
  • Taking instructions
  • The mental capacity assessment
  • What the Deputy’s responsibilities are
  • How is the application made?
  • What forms are used?
  • Fees
  • What happens after submission of forms?
  • What happens after the order has been made?
  • How the court supervises Deputies
  • What support the Deputy can expect from the court
