Family Care Payments - A Practical Guide for Lawyers

Introduction
Family care payments can provide an important way of recognising and supporting the financial arrangements involved when someone is cared for by a family member or other carer. However, lawyers advising clients in these circumstances need to understand when a payment is appropriate, when an application to the Court of Protection is required and how the payment should be calculated and administered.
This new virtual classroom seminar will examine the key legal and practical considerations when advising on family care payments, including situations where the carer moves into the cared for person’s home or the cared for person moves in with the carer. It will consider who should meet different costs, what benefits may be available and the longer-term implications of the arrangement, including issues arising when the cared for person dies and their estate needs to be dealt with.
The session will also look at the Court of Protection’s approach to family care payments, the application process and the factors the Court will take into account. Practical examples will be used throughout to demonstrate how payments can be calculated and paid and to highlight the issues lawyers should consider when advising carers and the cared for person.
