Introduction

A deed of family arrangement and variation is a mechanism by which to vary one’s beneficial share of an estate, so it passes to another. This arrangement is often used when inheritance tax planning for the beneficiary, but how will the Local Authority treat this arrangement if the person needs to go into care?

This new virtual classroom seminar is suitable for people who are already advising clients about the paying for care rules and who also advise on probate matters and estate administration, as well as professional attorneys and deputies. We will be looking at recent case law and working through case studies and examples.

What You Will Learn

This live and interactive course will cover the following:

  • A brief overview of deeds of family arrangement and variation
  • Typical stances by LAs in relation to these
  • Pitfalls and notes of caution against deeds of family arrangement and variation drawn up historically
  • Recent case law
  • How to approach a deed of family arrangement and variation in relation to a vulnerable person
  • Practical issues to be aware of and steps to take to minimise risk both to the client and professionally
