Introduction

Compensation claims arising out of breaches of data protection legislation are increasingly commonplace and controllers need to be able to respond to such claims effectively. In recent years, decisions of the courts of England and Wales and the European Court of Justice have provided greater clarity about how these cases should be dealt with. Furthermore, the recent decision of the Court of Appeal in the case of Farley v Paymaster [2025], which considers the existence of a minimum threshold, is of particular significance.
