Introduction

Disputes relating to cryptoassets have been increasing in recent years, along with the rise of the cryptoasset market.

There has also been a corresponding rise in the inclusion of cryptoassets and associated rights and interests in wills and trusts forcing private client solicitors to have to come to terms with how to deal with this new and sometimes confusing asset class.

The courts have now confirmed that cryptoassets are property and are making continuing efforts to identify their nature and effect.

Parliament has largely left them to the common law.

The basic principles behind cryptoassets can be obscure and tend to be counter-intuitive, resulting in the need for private client practitioners to revisit fundamental principles to fully grasp both the technical and proprietary aspects of these assets.
