Introduction
This virtual classroom seminar is for Scottish family lawyers who deal with financial separation and divorce. It is often the case that businesses fail to be considered when advising clients on what a fair and reasonable settlement looks like for their situation.
While family lawyers are not expected to be corporate lawyers or tax advisors, it is essential that family lawyers have a working knowledge of different business structures, how to deal with directors’ loans if applicable, tax consequences that can arise and how to understand forensic accountant reports.
This live session will look at recent case law on business and divorce centring around the hot topics of financial control/abuse in divorce cases involving businesses, how the court is dealing with competing business valuations, and the remedies the court is now prepared to employ where it is pleaded that there is a lack of resources to make an award where one of the major assets is shareholdings in a limited company.
This session will also cover practical tips when dealing with such cases.
