Introduction

This new, full-day course will provide a comprehensive and detailed review of both the FBT and AHA agricultural tenancy regimes and will provide delegates with the ability to deal with the issues that arise when it comes to dealing with both types of tenancy.

    • The implications of security of tenure and when an AHA can be terminated and how
    • How to deal with a tenant who is not paying rent or breaching the terms of the tenancy
    • How to deal with a landlord who is not adhering to landlord’s obligations
    • What considerations are there at the end of tenancy?
    • Section 6 and its implications
    • Statutory conversion into an AHA
    • How to deal with a rent review
  • In relation to both regimes, we will consider:
    • How to draft notices
    • Service of notices
    • Alternative dispute options
    • Negotiation and tactical considerations
    • Impact of changes to agricultural policy
    • The two codes of practice that are relevant to those working with agricultural tenancies i.e. Tenancy Reform Industry Group (‘TRIG’) Code of Good Practice for projects, schemes or works requiring landlord’s consent in agricultural tenancies - 1st Edition - July 2021
