Introduction
Commonhold is an alternative property ownership tenure to leasehold and is currently undergoing significant reform following the Law Commission’s review in 2020. The Government has repeatedly committed to banning the sale of leasehold flats and houses, with commonhold being the preferred tenure going forward.
The Government released a Commonhold White Paper in Spring 2025 setting out how they intend to implement commonhold, followed by the Draft Commonhold and Leasehold Bill 2026, which is currently under review. The Draft Bill proposes to make commonhold the default tenure and also improve commonhold management and converting leasehold to commonhold.
