Introduction

Paying funds into the Court Funds Office can provide a useful solution in a range of circumstances, but lawyers advising attorneys and deputies need to understand when funds should be paid into Court, how those funds are managed and the process for obtaining their release.

Land and property can also present particular challenges for attorneys and deputies, particularly where a Court of Protection order may be required. This practical new virtual classroom seminar will examine the limits of an attorney’s or deputy’s authority when dealing with land and property, when an application to the Court of Protection is necessary and how such applications can be approached.

The session will also consider how to protect the interests of the person whose property is being managed, including where land or property is jointly owned with trustees. The interaction between trusts, powers of attorney and deputyship will be explored, providing practical guidance for lawyers advising clients in these circumstances.
