Introduction

Are routine administration applications becoming a procedural risk?

For insolvency lawyers and practitioners, applications for administration orders and for extensions of administrators’ terms of office are a familiar feature of the Chancery applications lists. Their frequency and typically shortlisting times can create a temptation to treat them as routine, almost procedural ‘nodding’ exercises.

However, the Court’s expectations remain exacting. Even in seemingly straightforward applications, insufficient preparation or evidential gaps can lead to questions, delay, or judicial frustration. There is a clear need to ensure that each application is properly justified and presented in accordance with the applicable principles.

This new virtual classroom seminar will examine the legal and procedural framework governing administration orders and extensions of office, alongside the Court’s current approach in practice. It will equip you with practical guidance on how to present clear, well-supported applications that meet judicial expectations and avoid unnecessary difficulty.

  • The statutory purpose of administration and its role in determining whether an extension is justified, with reference to Key2Law (Surrey) LLP v De’Antiquis (Secretary of State for Business, Innovation and Skills intervening)
