This new virtual classroom seminar will cover all aspects of the phoenix provisions including the consequences of contravention and the exceptions in the Insolvency Rules 2016.

There will also be a particular focus on what the Court looks for in an application having regard to the relevant case-law and therefore practical steps to take to ensure an application is as effective as possible.

The session is suitable for insolvency solicitors and insolvency practitioners practising in England and Wales.

What You Will Learn

This live and interactive course will cover the following:

  • What constitutes contravention?
  • The consequences of contravention
  • When an application to Court is necessary, and when it is not
  • How to make the application
  • Evidence which can make or break an application
  • How a conversion from solvent to insolvent liquidation impacts the excepted cases in the Insolvency Rules 2016
  • Limits on the Court’s power to grant leave

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
