Introduction

The Law Society’s Conveyancing Quality Scheme is designed to improve standards of conveyancing practice, enhance conveyancers’ credibility and deter fraud.

This live broadcast session will examine the main aspects of a key pillar of the scheme: the Conveyancing Protocol, which was updated in August 2019.

One key objective is to provide a commentary on important elements of the Protocol and the implications for you in your day-to-day practice.

What You Will Learn

This live and interactive session will cover the following:

  • Regulatory requirements, including source of funds such as third-party contributions and verifying bank account conducted by the seller
  • Advising sellers on completing information forms
  • Identifying documents to be obtained and considered
  • Taking steps to protect the interests of the buyer
  • Addressing defects in title, missing documents (e.g. consents, guarantees, certificates, deeds)
  • Preparing and receiving the contract bundle
  • Additional enquiries: when to raise them and when not to
  • Leasehold conveyancing - enquiries, managing agents, third party consents to sale
  • Obtaining redemption statements, undertakings contained in the Law Society Code for Completion by Post (2019 ed.)
  • What the Protocol says about the Lenders’ Handbook, lender requirements, reporting to lender and acting solely for a lender
