Introduction

Following an independent review, commissioned by HM Government, of claims management regulation, in 2019 the Financial Conduct Authority (‘FCA’) took over from the Ministry of Justice as the regulator of claims management companies (‘CMCs’).

To bring claims management activities within the regulatory perimeter of the FCA, amendments were made to the Financial Services and Markets Act 2000 and the Financial Services and Markets Act 2000 (Regulated Activities) Order 2001.

This webinar will examine the statutory definition of regulated claims management activities, the statutory exclusions, and exemptions available to unauthorised persons, the regulatory risk to non-compliant CMCs and law firms involved with such entities, and the authorisation and supervision by the FCA of CMCs.
