The ‘Insurmountable Obstacles’ Test under Appendix FM - Latest Challenges & Developments
Introduction
Ever since the major changes to the Immigration Rules in 2012, the test of ‘insurmountable obstacles’ has been the subject of much litigation.
More than 10 years on, applicants and practitioners are now facing major changes to the levels of the Minimum Income Rule required to sponsor family members.
This short webinar will help practitioners understand what this test requires and how best to succeed in applications and appeals involving this threshold, particularly in those anticipated cases where the new Minimum Income Rules thresholds cannot be met.
What You Will Learn
This webinar will cover the following:
- The test of ‘insurmountable obstacles’ and how this is provided for in the Immigration Rules and relevant Home Office guidance
- An overview of the Courts’ guidance so far

This pre-recorded webinar will be streamed at 12:30pm on Wednesday 15th May 2024 and will remain available to view by delegates who have registered by then for 90 days.
