Rights to Light & Deeds of Release - A Practical Introduction
Introduction
Rights of light continue to be a contentious area of law. Even though a rights of light protocol was introduced in December 2023, developers still face challenges to their developments if neighbouring owners can prove their rights.
Whilst the Courts seem to be moving away from injunction-based relief in favour of those with rights, adjoining owners can still seek to ransom the development in return for negotiating damages (see the recent Bankside Yard case). If litigation can be avoided the developer and the adjoining owner will wish to record their agreement in a clear legally-binding way.
In this virtual classroom seminar we will explore the basics of an Agreement for Release and/or Deed of Release, and some of the nuances to watch out for in negotiating them.
