Introduction
The QOCS landscape shifted on 6 April 2023, with amendments to the CPR permitting greater recovery of costs by winning defendants in cases to which the rules apply, benefiting defendants and increasing risk and exposure for claimants and their representatives.
Litigators will likely have caseloads for some time that encompass claims subject to the old and new rules, and knowledge of the distinction, and the accumulating body of caselaw around QOCS, most particularly in relation to mixed claims, is essential for all practitioners.
