Introduction

This virtual classroom session is intended to clarify the law relating to the scope of a lawyer’s duty of care to their clients.

It is particularly aimed at lawyers seeking to gain a deeper understanding of the contractual and common law principles that underpin the general duty to a client, and what may fall within it.

In a situation where a client alleges that some task, advice, or action ought to have been taken but was not: in what circumstances would a court determine that this was negligent conduct? Very often, a client who has suffered some loss will turn to their lawyer and say: ‘Why didn’t you warn me about this?’
