Introduction

When a couple embarks on a marriage or civil partnership, the legal implications of doing so and the impact this may have on their financial position if the relationship comes to an end are not always considered. Steps can be taken to protect an individual’s position in the form of prenuptial agreement but how far does that protection extend and is it worth taking them?

This virtual classroom seminar is aimed at family lawyers who advise on financial and property matters in Scotland and may also be of interest to conveyancing and corporate or commercial lawyers.

What You Will Learn

This live and interactive course will cover the following:

  • Overview of prenuptial agreements and agreements entered into prior to a civil partnership
  • Consideration of the case law application to prenuptial agreements, in particular, how an agreement can be challenged
  • Consideration of the approach to be taken to prenuptial agreements with an inter-UK or international element - challenges concerning jurisdiction and applicable law
  • Challenges concerning the scope of the agreement and practical tips for lawyers drafting or advising on those
  • The interplay between cohabitation agreements and prenuptial agreements
  • The use of postnuptial agreements

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
