Planning Law Update - A Guide to Avoiding Costly Mistakes

Introduction

This live broadcast session is aimed at all property lawyers and surveyors who are asked to advise their clients on planning matters affecting property they already own or are thinking of acquiring whether by contract or option agreements.

This session will consider the possible impact of the latest planning reforms now being implemented, rather than the proposed reforms in the Government’s White Paper published in August. Particular attention will be given to the Infrastructure Levy replacing elements of S106 and CIL, affordable housing, protection of heritage assets and Permission in Principle.

The Government has recently updated the National Planning Policy Framework (NPPF). It is a significant departure from earlier versions and represents the most substantial change in planning policy in over a decade. In addition, the Planning and Infrastructure Act 2025 introduces new operational powers for local planning authorities, including compulsory delegation of decisions, locally‑set planning fees, a centrally managed nature restoration fund, and measures to speed up NSIP decisions. Furthermore, the English Devolution Bill is progressing and will bring the most extensive restructuring of local authorities since 1972.
