Pension Scheme Problem Areas & How to Tackle Them
Introduction
Pension schemes are intended to last a long time, and one result is that past events may still have significant consequences. Issues still arise as to the effect of documentation from the 1990s or even earlier, and when they emerge, they must be tackled.
This session will look at three well-known problem areas:
- Whether the scheme was equalised in response to the decision of the European Court of Justice in Barber
- Whether the final salary link was broken when the scheme became a defined contribution rather than a defined benefits scheme
- Whether the trustees and administrators dealt appropriately with transfer requests
What You Will Learn
This live and interactive course will cover the following:
- What to look for when considering whether there was a failure to equalise
- How to approach an equalisation correction exercise if necessary
- What to look for when considering whether there was a failure to break the final salary link
- How the additional liabilities are to be calculated if there was a failure
- What the responsibilities of trustees and administrators were in relation to transfers prior to the Pension Schemes Act 2015
- How to respond to claims about transfer requests
- When a professional negligence claim might help to reduce the overall cost of additional scheme liabilities
Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
