Introduction

Ensuring probation periods are properly managed has always been a key part of the employment lifecycle. A failure to assess a new recruit during their probation can create difficulties in the future, particularly if they are not a correct fit for organisation but have acquired the right to claim unfair dismissal.

The Employment Rights Bill proposes to give all employees the right to claim unfair dismissal from day one of their employment. This will be alongside an ‘initial period of employment’ which would allow an employer to dismiss an individual using a ‘light touch’ procedure.

However, this is currently being challenged by the Peers in the House of Lords, who have suggested that a 6-month qualifying period of employment should be required to bring a claim for unfair dismissal. Whatever the outcome, it will be essential to ensure that employees are properly managed from the outset and throughout the duration of their employment.

This webinar will provide practical guidance on how to effectively manage an individual who is poorly performing. It will also provide tips and considerations on how to investigate and manage poor performance, which may ultimately result in an exit from an organisation.
