Introduction

This new virtual classroom seminar will look at how to pursue intellectual property infringement proceedings in Ireland.

The session will provide practical guidance on identifying relevant IP rights, necessary pre-action steps, relevant points of pleading, and many aspects of litigation unusual to intellectual property proceedings in Ireland.

This live and interactive course will cover the following:

  • Planning a dispute (identifying IP rights at issue, parties, acts of infringement, jurisdictional issues, etc.)
  • Pre-action steps (correspondence, choice of forum, etc.)
  • Commencement of proceedings (how to commence, effecting service, etc.)
  • Interim and interlocutory injunctions (their role in IP disputes, availability of ex parte relief, tactical considerations, etc.)
  • Case management in the High Court
  • Pleadings (particular requirements for IP claims, defences, and counterclaims)
  • Discovery and its role in intellectual property disputes
  • Evidential issues in IP disputes
  • Trial process and appeals
