Introduction

Labour market competition law enforcement represents one of the most dynamic areas of development in both EU and UK competition law today.

Competition regulators have recently shifted from issuing abstract warnings about potential competition breach to radical enforcement of the rules together with the imposition of substantial fines. Employers now need to take note or face the consequences.

In recent years, competition authorities in the European Union and in the UK have for the first time ever found employer conduct unlawful under competition law.

Practices such as no-poaching agreements, wage fixing agreements, and collusive information sharing on pay are key areas of concern and now fall squarely within the enforcement sights of competition regulators.

These restrictions have the potential to harm workers' rights and stifle competition. Both EU and UK competition regulators now treat many such arrangements as serious restrictions on competition similar to classic cartel behaviour, such as fixing consumer process or dividing markets.
