How to Make a Valid LPA - Common Errors & Impending Changes
Introduction
In the 2023/24 tax year, the Office of the Public Guardian (‘OPG’) rejected around 50,918 LPA applications. It is also reported that over the past five years, a total of 162,023 LPA applications were rejected by the OPG.
The rejection by the OPG of LPA applications made by professionals is not only a source of embarrassment but could also result in delays, cost implications, complaints, the involvement of the Legal Ombudsman and negligence (especially if the Donor's capacity deteriorates to the extent that he or she is unable to execute new LPA documents).
