Honour Based Violence - A Guide for Criminal Lawyers
Introduction
Honour based abuse encompasses a large number of criminal offences and is a very difficult area for practitioners due to the cultural nuances of this area.
Offences involving Honour Based Abuse are prioritised by law enforcement agencies and incur sentencing uplifts, therefore it is important to be able to ascertain whether the case is actually motivated by honour. In such cases, victims and witnesses are often reluctant to give evidence against the perpetrators. It is important to be alive and sensitive to the needs of victims of Honour Based Abuse as it can differ from the issues posed by violence against women and domestic abuse.
Consequences of failures in this area have had far reaching consequences, including serious injury and death. Failure to act can result in victims being taken out of the jurisdiction to be abused abroad.
